Disclaimer & Service Terms
This disclaimer applies to the sale of products, rug cleaning, repairs, alterations and all other services (the “Services”) provided through the Oriental Moon website, shop and exhibitions operated by Oriental Art Co., Ltd. (“we”, “us” or “our”). By using the Services, you are deemed to have agreed to this disclaimer.
The handling of items entrusted to us for cleaning, repairs or alterations, our response to incidents and compensation are also governed by Care and Compensation for Rugs in Our Custody.
Article 1 — Scope of Liability
- If we are liable to compensate you in connection with the Services, our liability is limited to direct and ordinary loss actually caused by circumstances attributable to us. We are not liable for lost profits, lost opportunities, emotional distress or losses arising from special circumstances, even if foreseeable.
- Unless this disclaimer or our separate provisions state otherwise, compensation for our ordinary negligence is limited to the amount you actually paid us for the transaction that caused the loss.
- The exclusions and limitations in the preceding two paragraphs and elsewhere in this disclaimer do not apply to our intentional misconduct or gross negligence, or to death or personal injury.
Article 2 — Website Information
- We strive to provide accurate information on our website, but do not guarantee its completeness, accuracy, currency or usefulness. Content may be changed or removed without notice.
- Colours and textures in product photographs may appear different from the actual item because of photographic conditions or your display settings. Returns and exchanges for this reason are accepted within the scope of our returns and exchanges policy.
- If a system failure, input error or similar issue causes an obvious error in pricing, stock availability or product information, we may decline the order or cancel the contract. Any payment already received will be refunded in full.
- We are not responsible for the content or failures of external websites linked from our website or external services, including payment, delivery and social media services.
- We are not liable for losses caused by the unavailability of our website due to communications or server failures, maintenance or similar circumstances.
Article 3 — Characteristics of Handwoven Rugs
Many of the products we sell and the rugs entrusted to us are handwoven from natural materials. The following are inherent characteristics of handwoven rugs and are not defects or deficiencies in our work:
- Size variations of less than 5 cm from the stated measurements, which are taken at the widest part; uneven edges, rippling and asymmetry.
- Variations in weaving, colour shading (abrash), yarn thickness and knots.
- Initial shedding and the characteristic smell of wool.
- Individual variations in natural or plant-dyed colours and colour changes over time.
- Uneven fringe lengths or numbers of fringe strands.
Article 4 — Use of Products
- You are responsible for placing and using products appropriately. We are not liable for damage caused by:
- Slips, falls or injuries resulting from the absence of an anti-slip underlay or inappropriate placement.
- Deformation, discolouration or effects on flooring caused by use over underfloor heating or heated carpets.
- Discolouration, colour transfer, mould or insect damage caused by moisture, direct sunlight, high humidity or pet accidents.
- Colour transfer or marks on floors or furniture, or reactions with floor wax.
- The use of commercially available detergents, deodorising sprays or chemicals, or cleaning or repairs carried out by you or a third party.
- If you are allergic to natural materials such as wool or silk, please check the materials before purchasing.
Article 5 — Cleaning, Repairs and Alterations
- Agreement: By submitting a quotation form, placing an order or sending an item to us, you are deemed to agree to this disclaimer in full.
- Authority to request work: You warrant that you are entitled to request cleaning or other work on the item. Any dispute with a third party concerning ownership or other rights in the item must be resolved at your responsibility and expense.
- Acceptance of work: After examining an item, we may decline it without stating a reason if we consider the work difficult or unsafe. No service fee is charged if we decline before starting work.
- Inspection on arrival: We inspect and photograph items upon arrival. These records establish their condition when received. Dirt, damage, deterioration and previous repairs already present are not attributable to our work, whether or not identified during inspection.
- Working methods: We select the washing method, detergents, equipment, drying method and working procedure using our professional judgement, according to the condition of the item.
- Changes arising from the item itself: We are not liable for fading, dye bleeding, shrinkage, stretching, distortion, hardening, tearing, holes, fringe or edge damage, or other changes caused by:
- Insufficient colourfastness, unstable chemical dyes or inappropriate previous re-dyeing or colouring.
- Ageing, existing insect damage, mould, decay or weakened warp and weft foundations.
- Previous repairs, adhesives, backing treatments or similar work.
- Changes in fibres or dyes caused by pet urine, chemicals, food or beverages.
- Internal damage or deterioration that cannot be identified from the exterior when the item is received.
- Incorrect or missing information from you about the origin, materials, construction or treatment history.
- Normal changes during cleaning: The following may ordinarily occur when handwoven rugs are washed and are not treated as defects or incidents:
- Dimensional changes of approximately 3% or less in each direction, and minor unevenness or rippling at the edges.
- Changes in texture, feel, lustre or pile direction.
- Yellowing or discolouration remaining in the fringe.
- Existing wear, fading, repairs or weaving irregularities becoming visible after dirt is removed.
- Removal of dirt, odours and stains: Depending on their condition, stains, odours, discolouration and mould marks may not be completely removable. We do not guarantee the extent of removal or the finished condition. Differences in subjective assessment, including satisfaction with the result, do not qualify for reworking, refunds or compensation.
- Completion times: Quoted turnaround times are estimates and may be extended because of the item’s condition, weather, busy periods, additional work or other circumstances.
- Cancellation: If you cancel for your own reasons after the item arrives but before work begins, you must pay return shipping, unless we have expressly offered to cover it. If you cancel after work begins, you must pay for work already carried out and return shipping.
- Accessories and contents: We are not responsible for loss or damage to accessories packed with the item or objects attached to or embedded in the rug, such as jewellery or papers. Please do not include valuables.
- Advance disclosure of valuable items: When requesting service, you must disclose any item with a purchase price or current assessed value of JPY 1,000,000 or more, antiques, vintage pieces, rare items, works by renowned workshops or other items of exceptional value compared with ordinary rugs. We may request receipts, sales certificates, appraisals or other evidence. Undisclosed items are treated as set out in Care and Compensation for Rugs in Our Custody.
- Payment and return: Items are returned after payment is confirmed. We may retain the item until payment is completed.
- Checking the result: Please inspect your item as soon as possible after its return. If you have concerns, preserve its condition as far as possible and contact us with photographs. We may ask you to send it back for examination. We may be unable to respond to a claim after use, alteration, cleaning or repairs by another provider, disposal or other action prevents us from establishing the cause. Claim periods are set out in Care and Compensation for Rugs in Our Custody.
- Reworking: If a problem attributable to our work is confirmed, we prioritise reworking or repair. Compensation under the next paragraph is provided only where reworking or repair is difficult.
- Compensation: The amount, method and calculation of compensation for loss or damage caused by our ordinary negligence while an item is in our custody are governed by Care and Compensation for Rugs in Our Custody. If those provisions differ from this disclaimer, they take precedence for matters concerning the handling and compensation of items in our custody.
- Uncollected items: If we receive neither return instructions nor payment within 90 days of notifying you that work is complete, we may charge a reasonable storage fee. If one year has passed since that notification and you do not respond to a further notice, we may dispose of the item and charge you the disposal costs.
- Use of photographs: We may publish before-and-after photographs of items on our website or social media as examples of our work, without identifying individual customers. Please tell us when requesting service if you do not want photographs of your item published.
Article 6 — Delivery
- Loss, damage or delay while an item is being sent from you to us is handled under the carrier’s terms of carriage, and we are not liable. Risk in the item transfers to us when we receive it.
- For loss, damage or delay attributable to the carrier after we dispatch an item, we will assist with claims against the carrier and respond within the scope of its compensation coverage.
- We are not liable for theft, loss or damage after delivery by a method you specified, such as a delivery locker or unattended delivery.
- If a parcel is returned because of prolonged absence, an incorrect address, refusal of delivery or a similar reason, you must pay both the outbound and return shipping charges and the cost of reshipping.
Article 7 — Force Majeure
We are not liable where performance of all or part of the Services is delayed or prevented by natural disasters, fire, epidemics, war or conflict, import or export restrictions, economic sanctions, the enactment, amendment or repeal of laws, power failures, communications failures, transport accidents or delays, supplier circumstances or other events beyond our reasonable control.
Article 8 — Intellectual Property
Copyright and other rights in the text, photographs, videos, designs, logos and other content on our website belong to us or the relevant lawful rights holders. Unauthorised copying, republication, modification, secondary use or commercial use is prohibited. We may seek damages or take other legal action for infringements.
Article 9 — Refusal of Service
We may decline orders or service requests, terminate contracts or discontinue future dealings without prior notice in any of the following cases:
- Orders or requests using false information, impersonation or fraudulent payment.
- Non-payment or repeated unjustified refusal of delivery or prolonged absence.
- Abusive or intimidating behaviour towards our staff, excessive demands or conduct that disrupts our business.
- Orders we determine to be for resale.
- Where we determine that a person is an organised-crime or other antisocial-force affiliate, or has ties to such groups.
- Other circumstances in which we consider a transaction inappropriate.
Article 10 — Specific Guarantees
Specific guarantees or commitments expressly stated on product pages, in our returns and exchanges policy, cleaning information or other guidance—such as returns and refunds for initial defects or return shipping at our expense if you are dissatisfied—take precedence over this disclaimer within the scope stated. Care and Compensation for Rugs in Our Custody also takes precedence for the handling of items entrusted to us for cleaning, repairs or alterations, our response to incidents and compensation.
Article 11 — Severability
If any provision of this disclaimer, or part of a provision, is held invalid or unenforceable under the Consumer Contract Act or other applicable laws, the remaining provisions and the remaining portion of that provision continue to apply.
Article 12 — Changes
We may amend this disclaimer as necessary. Amendments take effect when posted on this page and apply to transactions entered into after the amendment.
Article 13 — Governing Law and Jurisdiction
This disclaimer is governed by Japanese law. Any dispute relating to the Services is subject to the exclusive jurisdiction, as the court of first instance, of the district court or summary court having jurisdiction over our registered head office.
